NYSED is prohibited by law as well as the rules and regulations of the Commissioner from certifying State Aid payments to districts against any claims which are submitted after one year from the end of the school year in which the aid is first paid or becomes payable.  For the current school year, the statute of limitations for aid payments against such claims for aid due for the 2016-17 year expires on June 30, 2018.  Therefore, districts must submit claims for any aid payments which were first paid or became payable during the 2016-17 school year no later than June 30th.  School districts that submit aid claims documentation and revisions beyond this deadline will forfeit aid payments against such claims.

Please keep in mind that these 2016-17 aid payments due to districts based on revised claim documentation (submitted between July 1, 2017 and June 30, 2018) will be treated as a prior year adjustment.  The prior year adjustments are payable on a delayed basis within the limits of annual State appropriations for such prior year adjustments.  Prior year adjustments are reviewed by the State Aid Unit and paid in the order received.

SED has provided a listing of claim documents that are subject to the statute of limitations for your reference which you can review here: https://stateaid.nysed.gov/latestnews/statlim1819.htm.  However, this listing is not all inclusive and may not necessarily represent a complete listing of all claim documentation that may be subject to the statute of limitations for your district.  Therefore, it is important that you perform a thorough review of your claim files and the calendar of deadlines under the State Aid website to be certain that all required documentation and revisions for claims or documents previously submitted are sent to SED on or before June 30, 2018.
